1. Who is responsible for this website

This website is operated by:

Damir Simovski (Simmation) Schildhornstrasse 91 12163 Berlin, Germany

Email: website@simmation.de Phone: +49 172 3105640

Damir Simovski is the controller responsible for the processing of personal data described in this policy, within the meaning of the General Data Protection Regulation (GDPR).

2. Hosting

This website is hosted by IONOS SE, a hosting provider based in Germany. When you visit this site, IONOS automatically processes technical information necessary to deliver the page to you, including your IP address, the date and time of access, the browser and device you used, and the page requested. This data is processed to ensure the website is delivered securely and reliably (legal basis: Art. 6(1)(f) GDPR — our legitimate interest in operating a functioning, secure website). This data is stored temporarily in server log files and is not merged with any other data we hold about you.

3. No analytics or tracking

This website does not use Google Analytics, Matomo, or any other analytics, tracking, or advertising tool. We do not build visitor profiles and do not track your behavior across this site or other websites.

4. When you contact us by email

If you contact us at website@simmation.de or by phone, we process the personal data you provide (such as your name, email address, and the content of your message) solely to respond to your inquiry and, where relevant, to prepare or carry out a contract with you (legal basis: Art. 6(1)(b) GDPR for contract-related inquiries, or Art. 6(1)(f) GDPR — our legitimate interest in responding to inquiries — for general questions).

We retain this correspondence for as long as necessary to handle your request. Where an inquiry leads to a business relationship or contract, related correspondence may be retained for up to 10 years in line with German commercial and tax retention obligations (§ 257 HGB, § 147 AO). Correspondence that does not lead to a contract is deleted once your inquiry has been fully resolved, unless we are required to keep it for legal reasons.

5. Cookies and consent management

This website uses a consent management tool („Real Cookie Banner“) to obtain your consent, where legally required, before any non-essential cookie or external content is loaded. You can view and change your cookie choices at any time via the cookie settings link in the footer of this website. Withdrawing consent does not affect the lawfulness of processing carried out before the withdrawal.

Strictly necessary cookies required for the basic functioning and security of the website are set without requiring consent (legal basis: Art. 6(1)(f) GDPR / § 25(2) TTDSG).

6. Google Fonts

This website uses Google Fonts, provided by Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland. When you visit a page using these fonts, your browser connects to Google’s servers to load them, which transmits your IP address to Google. This occurs only with your prior consent via the cookie banner (legal basis: Art. 6(1)(a) GDPR). Further information: Google’s Privacy Policy.

7. YouTube and Vimeo video embeds

Some pages on this website (for example, our portfolio and showreel pages) embed videos hosted on YouTube (operated by Google Ireland Limited) and/or Vimeo (operated by Vimeo.com, Inc., 555 West 18th Street, New York, NY 10011, USA). These embeds are blocked by default. They are only loaded — and only then connect to YouTube’s or Vimeo’s servers, which may transmit your IP address and set cookies — once you actively click to play the video and give your consent via our cookie banner (legal basis: Art. 6(1)(a) GDPR).

Because Vimeo is based in the United States, this may involve a transfer of your data outside the EU/EEA. Vimeo participates in the EU-U.S. Data Privacy Framework / relies on Standard Contractual Clauses as a transfer safeguard. Further information: YouTube’s Privacy Policy, Vimeo’s Privacy Policy.

8. Your rights

Under the GDPR, you have the right to:

  • request access to the personal data we hold about you (Art. 15 GDPR)
  • request correction of inaccurate data (Art. 16 GDPR)
  • request erasure of your data (Art. 17 GDPR)
  • request restriction of processing (Art. 18 GDPR)
  • receive your data in a portable format (Art. 20 GDPR)
  • object to processing carried out on the basis of our legitimate interest (Art. 21 GDPR)
  • withdraw any consent you have given, at any time, with effect for the future (Art. 7(3) GDPR)

To exercise any of these rights, contact us at website@simmation.de.

You also have the right to lodge a complaint with a data protection supervisory authority. The authority responsible for us is:

Berliner Beauftragte für Datenschutz und Informationsfreiheit Friedrichstraße 219, 10969 Berlin, Germany mailbox@datenschutz-berlin.de
